1. Introduction

Welcome to PineBrookPress ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at pinebrookpress.sbs (the "Service") operated by PineBrookPress.

By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Service Overview

PineBrookPress offers luxury yacht charter services, which include:

• Daily yacht rentals
• Sunset cruises
• Corporate retreats
• Private events
• Multi-day charters

Availability of services is dependent on weather conditions and we maintain the right to alter or discontinue services without prior notice.

3. Booking and Reservations

3.1 Booking Process

Requirements for booking a charter are as follows:

• Minimum age of 18 years
• Submission of complete and accurate information
• Payment of the specified deposit as indicated in the booking confirmation
• Acceptance of these Terms & Conditions

3.2 Confirmation

Confirmation of booking is upon payment and our formal confirmation. We reserve the right to decline service at our discretion.

3.3 Availability

Charter services are subject to the availability of the vessel and appropriate weather conditions. While we strive to honor preferred schedules, adjustments may be necessary.

4. Payment Terms

4.1 Pricing

Quoted prices are in € and already include any relevant taxes unless stated otherwise. Prices are subject to change without prior notice.

4.2 Payment Schedule

• Deposit: 50% of the full cost of the charter at the time of booking
• Balance: Required 48 hours prior to departure of the charter
• Extra charges, if applicable: Due upon charter completion

4.3 Payment Methods

We accept most major credit cards, bank transfers, and certified cheques. All payments are processed through secure and encrypted methods.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• More than 72 hours before departure: Full refund minus processing fees
• 24-72 hours before departure: 50% refund
• Less than 24 hours before departure: No refund

5.2 Weather Cancellations

In case the captain determines weather conditions are unsafe, we will:

• Offer to reschedule to an alternative date without additional fees
• Issue a full refund if rescheduling isn't feasible

5.3 Mechanical Issues

If there's a mechanical issue with the designated yacht, we will try to provide a comparable substitute. If that's not possible, a full refund will be issued.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

• Obey all instructions from the crew
• Use safety equipment when necessary
• Inform us of any medical conditions impacting their safety
• Stay within designated areas of the yacht

6.2 Prohibited Items

The following are not allowed on board:

• Glass bottles
• Illegal substances
• Weapons of any sort
• Excess non-alcoholic beverages
• Animals (unless prior approval is given)

6.3 Conduct

Guests are expected to behave respectfully. Charters may be terminated early without refund if passenger behavior endangers safety or detracts from the pleasure of others.

7. Liability and Insurance

7.1 Our Liability

We limit our liability to the cost paid for the charter. We are not accountable for:

• Injuries to individuals due to their own negligence
• The loss or destruction of personal items
• Indirect, consequential, or punitive damage
• Delays from weather or other uncontrollable factors

7.2 Insurance Coverage

Our operation and vessels are covered by extensive marine insurance. Passengers should secure their own travel and personal insurance.

7.3 Assumption of Risk

By partaking in our charter services, you acknowledge the inherent dangers of marine activities and accept personal responsibility for your safety and welfare.

8. Modifications and Itinerary Changes

We hold the right to revise itineraries, journeys, or schedules due to weather, safety, or operational needs. All efforts will be made to ensure a similar quality experience in such circumstances.

9. Force Majeure

We shall not be deemed responsible for changes, delays, or cancellations caused by events outside our control, including:

• Extreme weather events
• Natural calamities
• Government directives
• Port closures
• Technical malfunctions

10. Privacy and Data Protection

Your personal information is managed according to our Privacy Policy. Utilizing our services is equated to consenting to the collection and use of personal data as defined in the Privacy Policy.

11. Intellectual Property

Our website's content, such as texts, graphics, logos, and images, is under copyright and trademark protection. This content cannot be replicated, distributed, or altered without our express consent.

12. Governing Law

The laws of Spain govern these Terms. Disputes will be adjudicated in the courts of Valencia, Spain.
